PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY

These Terms and Conditions apply to travel advisory, booking and related services provided through Global Journeys.

Global Journeys operates as a travel brand within The Travel Agent Next Door and provides professional travel advisory and booking services to its clients.

Global Journeys operates in accordance with applicable Canadian and British Columbia laws and applicable travel-industry and consumer-protection requirements administered by Consumer Protection BC.

As Global Journeys operates within The Travel Agent Next Door, bookings arranged through Global Journeys are also subject, where applicable, to The Travel Agent Next Door's terms, conditions, policies and booking requirements.

These Global Journeys Terms and Conditions supplement, and do not replace, applicable terms and conditions of The Travel Agent Next Door or the independent travel suppliers providing the client's travel arrangements.

Travel services arranged through Global Journeys may include flights, accommodation, cruises, tours, safaris, transfers, excursions, vehicle rentals, rail travel, packages, travel insurance where applicable, and other travel-related services, collectively referred to as the “Travel Arrangements.”

For purposes of these Terms and Conditions:

“Global Journeys,” “we,” “us” and “our” refer to Global Journeys in its capacity as your travel advisor.

“You,” “your,” “traveller” and “client” refer to the person making the booking and, where applicable, all persons included in that booking.

“Supplier” means an independent airline, hotel, resort, lodge, cruise line, tour operator, wholesaler, safari operator, destination management company, transportation provider, vehicle rental company, excursion provider, insurance provider or other company providing a travel service.

1. BOOKING AND CONFIRMATION

1.1 Authority to Book

The person making the booking confirms that they:

  • are at least 18 years of age;
  • have authority to make the booking on behalf of all travellers included in the reservation;
  • have provided accurate information for all travellers;
  • are authorized to provide the personal information required for those travellers;
  • accept financial responsibility for amounts owing in connection with the booking; and
  • have made all travellers aware of the terms and conditions applicable to the booking.

1.2 Formation of a Booking

A quotation, proposal, itinerary or verbal discussion does not constitute a confirmed reservation.

Unless specifically stated otherwise in writing:

Price and availability are subject to change. Nothing is held or guaranteed until the required deposit or full payment has been successfully processed and the applicable Supplier has confirmed the reservation.

A booking becomes confirmed when the applicable Supplier accepts the reservation and the required payment has been processed.

1.3 Accuracy of Traveller Information

Clients must carefully review all confirmations, invoices, tickets, itineraries and travel documents immediately upon receipt.

Names must appear exactly as shown on the passport or other travel document that will be used for travel.

Any error or discrepancy must be reported to Global Journeys immediately.

Airlines and other Suppliers may charge fees or require cancellation and rebooking when traveller information is incorrect.

Global Journeys is not responsible for costs arising from incorrect information originally provided by the client.

2. RELATIONSHIP WITH TRAVEL SUPPLIERS

Global Journeys works with numerous independent travel Suppliers throughout Canada and internationally.

Unless expressly stated otherwise, Global Journeys acts as a professional travel advisor and booking agent in arranging services supplied by these independent Suppliers.

Each Supplier establishes its own contractual terms governing the services it provides.

These may include:

  • deposit requirements;
  • payment schedules;
  • final-payment deadlines;
  • fare rules;
  • amendment policies;
  • cancellation policies;
  • refund conditions;
  • non-refundable components;
  • change fees;
  • no-show provisions;
  • baggage policies;
  • minimum participation requirements; and
  • other booking conditions.

The applicable Supplier's terms and conditions form part of the terms governing the client's booking.

Global Journeys cannot override a Supplier's applicable contractual terms or policies.

3. PRICING AND AVAILABILITY

Travel pricing and availability can change without notice until a reservation is confirmed.

Prices may be affected by:

  • airfare changes;
  • Supplier price changes;
  • foreign-exchange fluctuations;
  • fuel surcharges;
  • government taxes;
  • airport and port charges;
  • resort or destination fees;
  • tourism levies; and
  • other Supplier or government-imposed charges.

Global Journeys will provide applicable pricing information before obtaining authorization to proceed with a transaction.

Once a Supplier has confirmed, ticketed or otherwise finalized a reservation, changes will be governed by the applicable Supplier terms.

4. DEPOSITS AND PAYMENT

There is no single Global Journeys deposit or payment schedule applicable to every booking.

Payment requirements are determined by the Supplier or Suppliers providing the Travel Arrangements.

Depending upon the booking, a Supplier may require:

  • a deposit;
  • staged payments;
  • full payment at booking;
  • final payment by a specified deadline; or
  • immediate payment for non-refundable services.

Clients are responsible for making payments by the deadlines communicated to them.

Failure to make payment by the required deadline may result in cancellation, loss of deposit, loss of availability, loss of previously quoted pricing or other Supplier-imposed penalties.

Global Journeys will communicate applicable payment requirements as part of the booking process.

5. CREDIT-CARD AND PAYMENT SECURITY

Global Journeys takes payment security seriously.

For your protection, credit-card security codes (CVV/CVC) must not be transmitted to Global Journeys through regular email or text message.

Where required, this information will be obtained through an approved secure process or directly by telephone.

Clients must only authorize charges after reviewing and approving the applicable travel arrangements and amount.

6. PROFESSIONAL AND SERVICE FEES

Global Journeys may charge professional, consultation, booking, ticketing, amendment, cancellation or other service fees.

Applicable Global Journeys fees will be disclosed as appropriate before the relevant service is provided.

Global Journeys professional fees are separate from fees, penalties or charges imposed by Suppliers.

Unless otherwise stated in writing or required by applicable law, professional fees may be non-refundable once the associated professional service has been performed.

7. SPECIAL REQUESTS

Clients should advise Global Journeys of special requests as early as possible.

These may include:

  • dietary requirements;
  • bedding preferences;
  • adjoining or connecting rooms;
  • seating requests;
  • accessibility requirements;
  • mobility assistance;
  • special occasion requests; and
  • other travel preferences.

Global Journeys will make reasonable efforts to communicate such requests to the applicable Supplier.

A request is not a guarantee.

Fulfilment remains subject to the Supplier's availability, policies and operational capabilities unless expressly confirmed by the Supplier.

8. MEDICAL, MOBILITY AND ACCESSIBILITY REQUIREMENTS

Clients should advise Global Journeys of any mobility requirement, disability, medical consideration or other circumstance that may materially affect their Travel Arrangements where that information is relevant to arranging appropriate travel services.

Global Journeys will make reasonable efforts to communicate relevant requirements to Suppliers.

Airlines, cruise lines, hotels, tour operators and other Suppliers establish their own accessibility, mobility and medical requirements.

Certain activities or travel experiences may have physical participation requirements.

Where appropriate, a Supplier may require medical documentation or confirmation that a traveller is fit to participate.

Travellers remain responsible for obtaining appropriate professional medical advice concerning their fitness to travel.

9. TRAVEL INSURANCE

Global Journeys strongly recommends comprehensive travel insurance appropriate to the client's individual circumstances and Travel Arrangements.

Depending upon the trip, appropriate coverage may include:

  • emergency medical expenses;
  • trip cancellation;
  • trip interruption;
  • baggage and personal effects;
  • travel delay;
  • missed connections;
  • emergency evacuation;
  • repatriation; and
  • applicable pre-existing medical conditions.

Some Suppliers or travel programs may require insurance as a condition of participation.

Clients are responsible for reviewing and understanding the terms, exclusions, limitations and coverage of any insurance policy purchased.

If a traveller elects to travel without adequate insurance, the traveller assumes responsibility for losses or expenses that might otherwise have been covered.

10. ACCOMMODATION RATINGS AND STANDARDS

Accommodation ratings are generally provided by the Supplier, destination or applicable rating organization.

Hotel and accommodation standards and star classifications are not internationally uniform.

A four-star property in one country may differ significantly from a four-star property in another country.

Ratings should therefore be regarded as general guidance rather than a guarantee of a uniform international standard.

11. CHANGES REQUESTED BY THE CLIENT

If a client wishes to change a confirmed booking, Global Journeys should be contacted as soon as possible.

We will make reasonable efforts to assist.

Changes remain subject to:

  • Supplier approval;
  • availability;
  • fare rules;
  • Supplier amendment fees;
  • differences in price;
  • applicable Global Journeys professional or amendment fees; and
  • other costs associated with the requested change.

Some Travel Arrangements cannot be amended after confirmation.

12. CANCELLATION BY THE CLIENT

Cancellation requests should be communicated to Global Journeys in writing as soon as possible.

Cancellation terms vary substantially between Suppliers and travel products.

Any cancellation, refund, future travel credit or other remedy is subject to applicable law and the terms of the Supplier or Suppliers involved.

A travel component may be:

  • refundable;
  • partially refundable;
  • subject to cancellation penalties;
  • eligible for future travel credit;
  • non-refundable; or
  • non-changeable.

Certain Travel Arrangements may become 100% non-refundable immediately upon confirmation, ticketing or payment.

Global Journeys does not impose a universal Supplier cancellation schedule because the actual terms vary according to the travel product purchased.

Any applicable Global Journeys professional or service fees are separate from Supplier-imposed cancellation penalties.

Nothing in these Terms and Conditions restricts a cancellation or refund right provided by applicable law that cannot legally be waived.

13. CHANGES OR CANCELLATIONS BY SUPPLIERS

Travel Suppliers may change or cancel confirmed arrangements.

Changes may include:

  • flight schedules;
  • airlines or aircraft;
  • accommodation;
  • room categories;
  • cruise itineraries;
  • ports;
  • transfers;
  • tours;
  • excursions;
  • transportation;
  • departure times; and
  • other travel components.

Global Journeys will make reasonable efforts to advise affected clients when we receive notice of a material change.

Where a Supplier offers a refund, credit, alternative arrangement or other remedy, the Supplier's applicable terms and legal obligations will determine the available options.

Global Journeys will assist clients in communicating with Suppliers but cannot guarantee the outcome offered by an independent Supplier.

14. FORCE MAJEURE AND EVENTS BEYOND REASONABLE CONTROL

Travel may be affected by circumstances outside the reasonable control of Global Journeys or the applicable Supplier.

These may include:

  • severe weather;
  • wildfire;
  • flood;
  • earthquake;
  • natural disaster;
  • epidemic or pandemic;
  • public-health emergency;
  • war;
  • terrorism or threat of terrorism;
  • civil unrest;
  • government action;
  • border closure;
  • labour dispute or strike;
  • airport or port closure;
  • transportation disruption;
  • air-traffic-control restrictions;
  • mechanical or technical problems;
  • acts of government or public authorities; and
  • other extraordinary events beyond reasonable control.

Refunds, credits, amendments and cancellations arising from such circumstances remain subject to applicable law and Supplier terms.

15. FLIGHT DELAYS, CANCELLATIONS AND MISSED CONNECTIONS

Flight schedules are controlled by airlines and aviation authorities and may change.

Travellers are responsible for checking their flight status and departure times.

If a flight is delayed or cancelled, or a connection is missed, travellers should contact the operating airline and Global Journeys as soon as reasonably possible.

Airline obligations concerning delays, cancellations, denied boarding and baggage are governed by applicable law, tariffs and conditions of carriage.

Global Journeys will provide reasonable assistance where possible but does not control airline operations.

16. PASSPORTS, VISAS, ENTRY AND HEALTH REQUIREMENTS

Each traveller is responsible for ensuring that they satisfy the passport, visa, immigration, entry, transit and health requirements applicable to their journey.

Requirements vary according to factors including:

  • citizenship;
  • passport held;
  • destination;
  • transit countries;
  • purpose of travel;
  • duration of stay; and
  • individual circumstances.

Global Journeys may provide general information and professional guidance regarding entry requirements.

However, governments, immigration authorities and border officials determine admission.

Requirements may change without notice.

Travellers are responsible for obtaining and carrying all required:

  • passports;
  • visas;
  • electronic travel authorizations;
  • entry permits;
  • vaccination or health documentation; and
  • other required travel documents.

Global Journeys is not responsible where a traveller is denied boarding or entry because applicable documentation or entry requirements have not been satisfied.

17. GOVERNMENT TRAVEL ADVISORIES

Travellers should review current Government of Canada travel advice and advisories applicable to their destinations before departure and while travelling.

Travel advisories, entry requirements and destination conditions may change with little or no notice.

The decision to travel remains with the traveller, subject to applicable laws, government restrictions and Supplier conditions.

18. TRAVELLER CONDUCT

Travellers are expected to behave responsibly and comply with applicable laws and reasonable rules established by Suppliers.

A Supplier may refuse service, remove a traveller or terminate services where behaviour creates a safety risk, significantly disrupts others, damages property or violates applicable rules.

Subject to applicable law, Global Journeys is not responsible for refunds or additional expenses resulting from a traveller being refused service or removed because of their own conduct.

Travellers may be financially responsible for damage or loss they cause.

19. UNUSED TRAVEL SERVICES

Unless otherwise provided by applicable law or Supplier terms, refunds are not guaranteed for portions of Travel Arrangements that a traveller voluntarily chooses not to use.

This may include unused:

  • flights;
  • accommodation;
  • transfers;
  • meals;
  • excursions;
  • tours;
  • cruise services; or
  • other travel components.

Any refund request will be subject to applicable Supplier terms and legal requirements.

20. BAGGAGE AND PERSONAL PROPERTY

Baggage allowances and restrictions vary between transportation providers.

Travellers are responsible for reviewing applicable baggage requirements before travel.

Additional charges may apply to checked, overweight or oversized baggage and special items, including sporting and ski equipment.

Loss, delay or damage involving baggage should be reported promptly to the applicable carrier and, where appropriate, to the traveller's insurance provider.

Global Journeys will provide reasonable assistance where appropriate but does not control airline or carrier baggage operations.

21. COMPLAINTS AND PROBLEMS DURING TRAVEL

If a client experiences a problem during travel, the matter should be reported immediately to the Supplier providing the service.

Clients should also contact Global Journeys as soon as reasonably possible if assistance is required.

Prompt notification gives the Supplier and Global Journeys an opportunity to investigate and, where possible, assist while the client is still travelling.

If the issue cannot be resolved during the trip, the client should provide Global Journeys with relevant information and supporting documentation following their return.

Where Global Journeys acts as booking agent for an independent Supplier, we may assist in communicating the complaint to that Supplier.

22. THIRD-PARTY SUPPLIERS AND RESPONSIBILITY

Many components of Travel Arrangements are provided by independent Suppliers that Global Journeys does not own or operate.

Global Journeys will exercise reasonable care in providing professional travel-advisory and booking services and in communicating information supplied to us.

Subject to applicable law, Global Journeys is not responsible for independent operational acts or omissions of third-party Suppliers outside our reasonable control.

Nothing in these Terms and Conditions excludes or limits any liability, consumer right or remedy that cannot lawfully be excluded or limited.

23. TRAVEL INFORMATION AND DESTINATION CONDITIONS

Global Journeys may provide destination information as part of our professional travel-advisory services.

Conditions at destinations can change after booking.

Changes may include:

  • weather;
  • construction;
  • transportation disruption;
  • local events;
  • attraction closures;
  • government restrictions;
  • health requirements;
  • security conditions; and
  • other circumstances outside Global Journeys' reasonable control.

Travellers should review current destination information before departure.

24. CONSUMER PROTECTION BRITISH COLUMBIA

Global Journeys conducts its travel-advisory and booking activities in accordance with applicable British Columbia travel-industry and consumer-protection requirements.

Travel bookings may constitute consumer contracts under British Columbia law and, depending upon the circumstances, may include distance-sales and/or future-performance contracts.

Global Journeys follows applicable requirements concerning pre-contract information, booking documentation, invoices, receipts, payments and other required consumer disclosures.

Nothing contained in these Terms and Conditions is intended to restrict, waive or eliminate any consumer right or remedy that cannot legally be waived under applicable British Columbia law.

Where a provision of these Terms and Conditions conflicts with a mandatory requirement of applicable British Columbia consumer-protection law, the mandatory legal requirement will apply.

25. TRAVEL ASSURANCE AND BUSINESS PROTECTION

Global Journeys operates within the applicable Consumer Protection BC travel-industry regulatory framework and maintains applicable insurance coverage for its operations.

Consumer Protection BC administers the Travel Assurance Fund, which may provide eligible consumers with protection in qualifying circumstances involving travel services purchased through licensed British Columbia travel businesses.

Eligibility and claims are determined under the applicable legislation, regulations and Consumer Protection BC requirements.

The Travel Assurance Fund does not replace comprehensive personal travel insurance.

No provision in these Terms and Conditions should be interpreted as a guarantee that a particular loss will be covered by Global Journeys' business insurance, the Travel Assurance Fund or a traveller's own insurance policy.

26. DATA PROTECTION AND PRIVACY

Global Journeys collects, uses and discloses personal information in accordance with the Global Journeys Privacy Policy.

Arranging international travel may require personal information to be transmitted to Suppliers located in Canada and other countries.

Clients should review the Global Journeys Privacy Policy for information concerning the collection, use, disclosure, protection and international processing of personal information.

For payment security, sensitive credit-card security information should only be provided through approved methods.

27. BOOKING DOCUMENTS AND CONTRACT INFORMATION

Clients are responsible for reviewing all documentation supplied by Global Journeys and applicable Suppliers.

Depending upon the booking, documentation may include:

  • quotations and proposals;
  • invoices;
  • receipts;
  • booking confirmations;
  • airline tickets;
  • itineraries;
  • hotel and transfer vouchers;
  • cruise documents;
  • tour documents;
  • insurance documents;
  • fare rules; and
  • Supplier terms and conditions.

Any discrepancy should be reported to Global Journeys immediately.

Global Journeys provides booking documentation and required contract information in accordance with applicable British Columbia requirements.

28. RELATIONSHIP BETWEEN APPLICABLE TERMS

A booking arranged through Global Journeys may be governed by several complementary sets of terms, including:

  • these Global Journeys Terms and Conditions;
  • applicable The Travel Agent Next Door terms, conditions and policies;
  • the terms and conditions of each applicable travel Supplier;
  • applicable airline or transportation-provider fare rules and conditions of carriage;
  • applicable insurance-policy terms where insurance has been purchased; and
  • applicable Canadian and British Columbia law.

Where a Supplier's terms specifically govern the travel service provided by that Supplier, those terms apply to the Supplier's provision of that service, subject to applicable law.

Nothing contained in these Terms and Conditions, The Travel Agent Next Door's terms or a Supplier's terms overrides a statutory consumer protection that cannot legally be waived.

29. APPLICABLE LAW

These Terms and Conditions and Global Journeys' professional travel-advisory and booking services are subject to applicable laws of British Columbia and Canada.

Supplier contracts may contain separate governing-law or jurisdiction provisions applicable to disputes involving that Supplier.

Nothing in these Terms and Conditions limits statutory rights or remedies that cannot legally be waived.

30. SEVERABILITY

If any provision of these Terms and Conditions is determined to be invalid, illegal or unenforceable, the remaining provisions will continue in effect to the extent permitted by law.

CLIENT ACKNOWLEDGEMENT

By authorizing Global Journeys to proceed with a booking and/or providing the required payment, the client acknowledges that they have been provided with the applicable booking information and agree to these Terms and Conditions together with the applicable terms and conditions governing their Travel Arrangements.

The person making the booking confirms that they have authority to act on behalf of the other travellers included in the booking and will ensure that those travellers are made aware of the applicable booking terms and requirements.
